use_theme_fonts=\u00bbyes\u00bb][divider line_type=\u00bbNo Line\u00bb custom_height=\u00bb15&#8243;][vc_column_text]<span style=\"font-weight: 400;\">El objetivo de la Ley de Protecci\u00f3n de los Trabajadores de la Confecci\u00f3n es mejorar las condiciones laborales de los aproximadamente 45.000 trabajadores de la confecci\u00f3n empleados en California, la mayor\u00eda de los cuales son mujeres inmigrantes.<\/span><\/p>\n<p><strong>Entre otras cosas, la Ley:<\/strong>[\/vc_column_text][divider line_type=\u00bbNo Line\u00bb custom_height=\u00bb15&#8243;]<div class=\"nectar-fancy-ul\" data-list-icon=\"fa fa-check-square-o\" data-animation=\"false\" data-animation-delay=\"0\" data-color=\"accent-color\" data-spacing=\"default\" data-alignment=\"left\"> \n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Proh\u00edbe a los empleadores pagar a los empleados por pieza; <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Crea responsabilidad solidaria por salarios impagados para los \u201c<strong>garantes de marca<\/strong>\u201d, junto con los fabricantes y contratistas; use_theme_fonts=\u00bbyes\u00bb][divider line_type=\u00bbNo Line\u00bb custom_height=\u00bb15&#8243;][vc_column_text]<span style=\"font-weight: 400;\">La Ley es significativa por varias razones. <\/span>[\/vc_column_text][divider line_type=\u00bbNo Line\u00bb custom_height=\u00bb15&#8243;]<div class=\"nectar-fancy-ul\" data-list-icon=\"fa fa-arrow-right\" data-animation=\"false\" data-animation-delay=\"0\" data-color=\"accent-color\" data-spacing=\"default\" data-alignment=\"left\"> \n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>En primer lugar, la eliminaci\u00f3n del pago por pieza garantiza que los trabajadores reciban al menos el salario m\u00ednimo por todas las horas trabajadas.<\/b><span style=\"font-weight: 400;\"> Adem\u00e1s, dado que el trabajo a destajo prioriza la velocidad, exigir a los empleadores que paguen a los trabajadores por hora puede reducir los riesgos de salud y seguridad en el lugar de trabajo. Seg\u00fan la Ley, por cada per\u00edodo de pago en el que un empleado reciba pago por pieza, los fabricantes y contratistas de prendas de vestir estar\u00e1n sujetos a da\u00f1os compensatorios de 200 $ por empleado.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>En segundo lugar, la Ley aclara las ambig\u00fcedades en las leyes existentes sobre trabajadores de la confecci\u00f3n,<\/b><span style=\"font-weight: 400;\"> que permit\u00edan a las marcas de ropa con grandes recursos evitar ser clasificadas como fabricantes de prendas de vestir y, por lo tanto, eludir la responsabilidad por violaciones de salarios y horas mediante la creaci\u00f3n de m\u00faltiples capas de contratistas y subcontratistas. Seg\u00fan la Ley, un trabajador de la confecci\u00f3n puede recuperar salarios impagos, as\u00ed como sanciones civiles, intereses y honorarios de abogados, no solo del fabricante o contratista de prendas de vestir, sino tambi\u00e9n del garante de marca.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Por \u00faltimo, la Ley impone requisitos mejorados de mantenimiento de registros a los fabricantes de prendas de vestir.<\/b>  Seg\u00fan la Ley, los fabricantes de prendas de vestir deben conservar los registros de control de tiempo, n\u00f3mina y producci\u00f3n durante cuatro a\u00f1os.
